Apple fined $1 million by Paris Court, here’s why

The Paris Commercial Court has fined iPhone maker Apple with over 1 million euros ($1.06 million). The fine has been imposed for abusive commercial clauses on French app developers for access to the company’s App Store, as per the court ruling. According to the ruling, there was no need to order Apple to change the App Store‘s clauses because the European Union‘s incoming Digital Markets Act would require changes in any case.
Though the Paris court’s fine is small, it signifies the legal pressures Apple faces with regard to App Store policies worldover. Apple App Store is the only place for app developers to take their apps to iPhone users. As Apple does not allow sideloading of apps. Google too though does not ban it, the company does tell Android users to avoid sideloading as it can be dangerous for their device and data. As the apps downloaded from third-party app stores do not undergo the mandatory security checks that the apps on Apple App Store and Google Play Store go through. This also means checks on the data that the app users of customers.

An Apple spokesman said that the company would review the ruling. The statement further added that the company believes “in vibrant and competitive markets where innovation can flourish.” “Through the App Store, we’ve helped French developers of all sizes share their passion and creativity with users around the world while creating a secure and trusted place for customers,” the spokesman added.
Apple faces heightened scrutiny over its contractual practices following the adoption of new EU legislation that targets so-called digital “gatekeepers” online. The Digital Markets Act (DMA) that came into force on November 1, will force Apple and other technology companies to provide space for third-party app stores on their respective iOS and Android devices.
The DMA has a six-month implementation stage before it starts to apply for the most part from May 2, 2023.
